You’ve helped me a lot this week – thank you! Last week I set out to explain the law on rape, and then my brief summary, so that readers would not only be able to understand the law in a general sense, but also to appreciate the work that has been done to produce the law as it stands.
This week, we’ll look at some of the exceptions that may apply. The law does not apply to sex acts that are consensual. This means that, in practice, if two people, aged 16 or older, have had sex, and there is no evidence that either has been harmed in any way, then their act does not have to be prosecuted, and the law is not violated.
These types of sexual encounters are categorised as ‘consensual’. Consent is an active rather than a passive process. So, for example, consent may be that a person gives explicit consent to sexual activity by being drunk or high, or by being unable to give informed consent because they are unconscious, or because they are mentally incapable.
Sometimes, it is accepted that ‘consent’ is not being given by one person, but instead is given by two or more people together. This is most often where the law states that there is ‘joint consent’.
It is not enough for just one person to say that they are consenting to sexual activity, if the other person does not consent, because that is not consenting in the law.
If it is not necessary for two people to consent together, it is more likely that it is one person who is consenting, and someone who is not consenting, because the law requires it. For example, if one person is able
